Abstract

An examination of hyperlinking, differentiating between surface and deep linking, and legal examples that illustrate the difficulties and legal reactions to these activities comprise the first part of the talk. It then discusses the unique legal structure in India, including the duties and obligations of Internet Service Providers (ISPs) in copyright infringement cases, as well as how the Indian Copyright Act tackles these concerns. In the context of adaptation rights, the article delves more into the notions of in-lining and framing, elaborating on how these technologies may violate the rights of copyright holders. Aspects of the Information Technology Act of 2000 that pertain to the liability of ISPs under Indian law are also examined. The study also examines the wider ramifications of technology progress on copyright legislation in India, outside the scope of these particular technologies. The text examines the modifications made to the Indian Copyright Act in order to bring it into conformity with global accords such as the WIPO treaties and to meet the demands of the digital age. Particular attention is paid to the legal procedures included in managing copyright infringement cases using digital material, fair use exemptions, rights management, and other pertinent areas of copyright law. The abstract provides a comprehensive examination of the ways in which technological progresses pose a challenge to conventional copyright legislation, the legal reactions and adjustments that have occurred within the context of Indian law, and the continuous endeavours to harmonise the entitlements of copyright holders with the practicalities of the digital era.
